1. כללי

ברוכים הבאים ל"גרוייסע גמל" (להלן: "האפליקציה"). השימוש באפליקציה מהווה הסכמה מלאה לתנאי שימוש אלה. אם אינך מסכים לתנאים — אנא הימנע משימוש באפליקציה.

האפליקציה מיועדת למשתמשים בגירים (18+). מפעיל האפליקציה ניתן ליצירת קשר בכתובת: support@groys.dev.

2. מהות השירות — מידע והשוואה בלבד

האפליקציה היא כלי מידע והשוואה של נתוני תשואות פומביים של מוצרי חיסכון פנסיוני בישראל (קופות גמל, קרנות השתלמות, קרנות פנסיה, קופות גמל להשקעה, פוליסות חיסכון וחיסכון לכל ילד).

האפליקציה, מפעילה ותכניה אינם מהווים ולא יהוו: ייעוץ פנסיוני, שיווק פנסיוני, ייעוץ השקעות, שיווק השקעות, ייעוץ מס או המלצה לביצוע פעולה כלשהי, לרבות הצטרפות, עזיבה או מעבר בין מוצרים או מסלולים. מפעיל האפליקציה אינו בעל רישיון ייעוץ או שיווק פנסיוני ואינו נמצא בקשר מסחרי עם הגופים המנהלים המוצגים.

3. מקור הנתונים ואמינותם

הנתונים המוצגים מקורם במאגרי המידע הפומביים של רשות שוק ההון, ביטוח וחיסכון (גמל-נט, פנסיה-נט, ביטוח-נט) באמצעות data.gov.il, ומתעדכנים בדרך כלל אחת לחודש. חודש הנתונים העדכני מוצג בכל מסך רלוונטי.

הנתונים מוצגים כפי שהם (AS IS). ייתכנו טעויות, עיכובים, אי-דיוקים או שינויים במקור. מפעיל האפליקציה אינו מתחייב לשלמות, לדיוק או לעדכניות הנתונים, ואינו אחראי לנתונים שמקורם בגופים המנהלים או ברשות.

בפרט: דמי הניהול, מדד שארפ, אלפא והיקף הנכסים המוצגים הם ערכים ממוצעים או מחושבים כפי שדווחו על ידי הגופים המנהלים לרשות, בקירוב בלבד. דמי הניהול המוצגים אינם בהכרח התעריף האישי שלך. ייתכנו טעויות בערכים — יש לאמת כל נתון מול הגוף המנהל לפני קבלת החלטה.

4. אחריות המשתמש והיעדר הסתמכות

כל החלטה פיננסית היא באחריות המשתמש בלבד. תשואות עבר אינן מבטיחות ואינן מעידות על תשואות עתיד. לפני קבלת החלטה בנוגע לחיסכון פנסיוני מומלץ לפנות לבעל רישיון מתאים (יועץ פנסיוני או סוכן שיווק פנסיוני), הפועל בהתאם לצרכיך האישיים.

5. מחשבון דמי הניהול

מחשבון דמי הניהול מבוסס על הנחות פשטות (תשואה קבועה, הפקדה קבועה, ריבית דריבית חודשית) ונועד להמחשה בלבד. תוצאותיו אינן תחזית, אינן הבטחת תשואה ואינן ייעוץ.

6. קישורים לאתרים חיצוניים

האפליקציה כוללת קישורים לאתרי בתי השקעות וגופים מנהלים. הקישורים ניתנים לנוחות בלבד, בסדר אלפביתי וללא העדפה. ההצטרפות למוצר כלשהו, תנאיה ותוצאותיה — הם בין המשתמש לגוף המנהל בלבד. מפעיל האפליקציה אינו צד לעסקה, אינו מקבל תמורה בגין ההפניה ואינו אחראי לתוכן, לזמינות או לתנאים באתרים חיצוניים.

7. קניין רוחני

עיצוב האפליקציה, הקוד, הסימנים והתכנים המקוריים שבה שייכים למפעיל האפליקציה. נתוני הקרנות עצמם הם מידע ציבורי שמקורו ברשויות המדינה. סימני המסחר, השמות והלוגואים של הגופים המנהלים שייכים לבעליהם, ומוצגים באפליקציה לצורכי זיהוי בלבד — ללא חסות, שיתוף פעולה או קשר מסחרי (שימוש אמת לפי סעיף 47 לפקודת סימני מסחר). בעל זכויות הסבור כי הצגת סימן פוגעת בזכויותיו מוזמן לפנות אל support@groys.dev — והסימן יוסר או יתוקן בהקדם. אין להעתיק, לשכפל או לעשות שימוש מסחרי בתכני האפליקציה ללא אישור מראש ובכתב.

8. הגבלת אחריות

השירות ניתן כפי שהוא וללא אחריות מכל סוג. בגבולות המותר על פי דין, מפעיל האפליקציה לא יישא באחריות לכל נזק — ישיר, עקיף, תוצאתי או אחר — הנובע משימוש באפליקציה, מהסתמכות על הנתונים, מטעויות בנתונים, מהפסקת השירות או מאי-זמינותו.

9. זמינות ושינויים בשירות

מפעיל האפליקציה רשאי לשנות, להשעות או להפסיק את האפליקציה או חלקים ממנה בכל עת וללא הודעה מוקדמת, לרבות שינוי היקף הנתונים, הגופים או המסלולים המוצגים. בעתיד עשויות להשתלב באפליקציה מודעות פרסומת.

10. פרטיות

האפליקציה תוכננה לפעול ללא חשבונות משתמש וללא איסוף מידע אישי. פרטים מלאים — במדיניות הפרטיות, המהווה חלק בלתי נפרד מתנאים אלה.

11. חנויות האפליקציות

האפליקציה מופצת דרך App Store של Apple ו-Google Play, והשימוש בה כפוף גם לתנאי החנות שממנה הורדה. הסכם תנאים זה נכרת בינך לבין מפעיל האפליקציה בלבד — לא עם Apple. Apple וחברות הבת שלה הן מוטבות צד שלישי של תנאים אלה וזכאיות לאוכפם כלפיך. Apple ו-Google אינן אחראיות לאפליקציה, לתחזוקתה, לתמיכה בה או לכל טענה הנוגעת לה (לרבות אחריות למוצר, אי-התאמה לדין או הפרת קניין רוחני); אחריות בעניינים אלה, ככל שקיימת, חלה על מפעיל האפליקציה בלבד ובכפוף להגבלות שבתנאים אלה. אתה מצהיר כי אינך שוהה במדינה שחל עליה חרם מטעם ממשלת ארה"ב ואינך מופיע ברשימת גורמים אסורים כלשהי.

12. נגישות

מפעיל האפליקציה רואה חשיבות בהנגשת השירות לכלל המשתמשים. האפליקציה כוללת, בין היתר, התאמת גודל טקסט, תמיכה בכיווניות ימין-לשמאל (עברית) ותאימות לקוראי המסך של מערכת ההפעלה. אנו פועלים לשיפור מתמיד של הנגישות. נתקלת בקושי נגישות או שיש לך הצעה לשיפור? נשמח לפנייה בכתובת support@groys.dev ונטפל בכך בהקדם.

13. שינויים בתקנון

מפעיל האפליקציה רשאי לעדכן תקנון זה מעת לעת. הנוסח העדכני יוצג באפליקציה בציון תאריך עדכון. המשך שימוש לאחר עדכון מהווה הסכמה לנוסח המעודכן.

14. דין וסמכות שיפוט

על תנאים אלה יחולו דיני מדינת ישראל בלבד. סמכות השיפוט הבלעדית נתונה לבתי המשפט המוסמכים במחוז תל אביב-יפו.

Welcome to "Groyse Gemel" (the "App"). Using the App constitutes full acceptance of these Terms of Use. If you do not agree — please do not use the App.

The App is intended for adults (18+). The App operator can be contacted at: support@groys.dev.

These Terms are a convenience translation. The binding version is the Hebrew version; in case of any discrepancy, the Hebrew version prevails.

2. Nature of the service — information and comparison only

The App is an information and comparison tool for public return data of Israeli long-term savings products (provident funds (Gemel), study funds (Hishtalmut), pension funds, investment provident funds (Gemel LeHashkaa), savings policies and child savings).

The App, its operator and its content do not constitute pension advice, pension marketing, investment advice or marketing, tax advice, or a recommendation to take any action, including joining, leaving or switching products or tracks. The operator holds no advisory or marketing licence and has no commercial relationship with the managing bodies displayed.

3. Data source and reliability

Displayed data originates from the public databases of the Israeli Capital Market, Insurance and Savings Authority (Gemelnet, Pensianet, Bituach-net) via data.gov.il, typically updated monthly. The current data month is shown on every relevant screen.

Data is presented AS IS. Errors, delays, inaccuracies or changes at the source are possible. The operator does not warrant completeness, accuracy or timeliness, and is not responsible for data originating from the managing bodies or the Authority.

In particular: the management fees, Sharpe ratio, alpha and assets figures shown are average or computed values as reported by the managing bodies to the Authority, and are approximate only. The displayed management fee is not necessarily your personal rate. Values may contain errors — verify any figure with the managing body before making a decision.

4. User responsibility; no reliance

Every financial decision is the sole responsibility of the user. Past returns do not guarantee and do not indicate future returns. Before making any pension-savings decision, consult an appropriately licensed professional acting according to your personal needs.

5. Fee calculator

The management-fee calculator relies on simplifying assumptions (constant return, constant deposits, monthly compounding) and is for illustration only. Its results are not a forecast, not a promise of returns and not advice.

6. External links

The App includes links to the websites of investment houses and managing bodies, provided for convenience only, in alphabetical order and without preference. Joining any product, and its terms and consequences, are strictly between the user and the managing body. The operator is not a party to the transaction, receives no consideration for the referral, and is not responsible for external sites.

7. Intellectual property

The App design, code, marks and original content belong to the operator. Fund data itself is public information originating from state authorities. Trademarks, names and logos of the managing bodies belong to their owners and are displayed for identification purposes only — with no sponsorship, affiliation or commercial relationship (nominative fair use; sec. 47 of the Israeli Trade Marks Ordinance). A rights holder who believes a mark is displayed improperly may contact support@groys.dev and it will be promptly removed or corrected. No copying, reproduction or commercial use of App content is allowed without prior written consent.

8. Limitation of liability

The service is provided as is, without warranty of any kind. To the extent permitted by law, the operator shall not be liable for any damage — direct, indirect, consequential or otherwise — arising from use of the App, reliance on the data, data errors, service interruption or unavailability.

9. Availability and changes

The operator may modify, suspend or discontinue the App or parts of it at any time without prior notice, including the scope of data, bodies or tracks displayed. Advertisements may be introduced into the App in the future.

10. Privacy

The App is designed to work without user accounts and without collecting personal information. Full details are in the Privacy Policy, which forms an integral part of these Terms.

11. App stores

The App is distributed via Apple's App Store and Google Play, and use is also subject to the terms of the store from which it was downloaded. This agreement is concluded between you and the App operator only — not with Apple. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Apple and Google are not responsible for the App, its maintenance or support, or any claim relating to it (including product liability, legal or regulatory non-compliance, or intellectual-property infringement); responsibility for such matters, if any, rests solely with the operator, subject to the limitations in these Terms. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any restricted-parties list.

12. Accessibility

The operator values making the service accessible to all users. The App includes, among others, adjustable text size, right-to-left support (Hebrew) and compatibility with the operating system's screen readers. We work to continually improve accessibility. If you encounter an accessibility difficulty or have a suggestion, please contact support@groys.dev and we will address it promptly.

13. Changes to these Terms

The operator may update these Terms from time to time. The current version, with its update date, is displayed in the App. Continued use after an update constitutes acceptance.

14. Governing law and jurisdiction

These Terms are governed solely by the laws of the State of Israel. Exclusive jurisdiction is vested in the competent courts of the Tel Aviv-Jaffa district.
